1. Definitions

"MedSuite" refers to the digital medical management platform operated through this website and application, including all of its modules, features and associated services.

"User" refers to any natural person who accesses, registers on or uses the MedSuite platform in any of its forms.

"Health Professional" or "Doctor" refers to users registered with the doctor role, who declare that they have the training, professional license and legal permits required to practice medicine in the United Mexican States.

"Patient" refers to users registered with the patient role who use the platform to manage their medical appointments, clinical records and prescriptions.

"Clinical Content" refers to all medical information generated, stored or processed through the platform, including clinical records, SOAP notes, vital signs, diagnoses, prescriptions and medical documents.

2. Terms of Service

2.1. MedSuite is a platform for managing medical appointments, clinical records, medical prescriptions and administrative tools for health professionals and their patients. The platform facilitates the organization and digital record-keeping of medical practice.

2.2. Use of the platform implies full and unconditional acceptance of these terms and conditions. If the user does not agree with any provision, they must refrain from using the platform.

2.3. The user agrees to provide truthful, complete and up-to-date information during the registration process and at all times while using the platform. Providing false information may result in the immediate suspension or cancellation of the account.

2.4. MedSuite reserves the right to suspend, limit or cancel the accounts of users who violate these terms, misuse the platform, or whose behavior endangers the security, integrity or operation of the service.

2.5. Health Professionals who register on the platform must complete an identity and professional credential verification process. MedSuite reserves the right to approve or reject verification requests in accordance with its internal policies.

2.6. The platform operates under a tiered subscription model (Free, Pro and Master). Each tier offers different usage limits and features. Details of each plan are available in the platform's subscriptions section.

2.7. MedSuite is committed to keeping the platform continuously available; however, it does not guarantee uninterrupted availability of the service. There may be scheduled maintenance periods or interruptions due to force majeure.

3. Medical Disclaimer of Liability

3.1. MedSuite is exclusively an administrative and document management tool. The platform does NOT provide medical diagnoses, treatments, therapeutic recommendations or medical opinions of any kind.

3.2. The platform facilitates communication, organization and document record-keeping between health professionals and patients, but under no circumstances does it replace in-person medical consultation, the doctor-patient relationship or professional clinical judgment.

3.3. Health Professionals who use the platform are solely responsible for their clinical decisions, diagnoses, treatments, prescriptions and any medical act they perform. MedSuite acts only as a means of record-keeping and document management.

3.4. MedSuite, its developers, administrators and staff are not responsible for errors, omissions, negligence or adverse consequences arising from medical decisions, diagnoses or treatments made by professionals registered on the platform.

3.5. Medical prescriptions generated through the platform are the sole responsibility of the Health Professional who issues them. MedSuite provides only the formatting and document generation tool.

3.6. In the event of a medical emergency, the user must immediately contact local emergency services (911) or go to the nearest medical care facility. MedSuite is not an emergency care service.

3.7. The use of information contained in digital clinical records does not replace the patient's official medical history. Health Professionals are responsible for maintaining records in accordance with applicable regulations (NOM-004-SSA3-2012).

4. Privacy Notice and Personal Data Protection

4.1. In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations, MedSuite is committed to protecting the privacy and security of the personal data of all its users.

4.2. Data we collect:

  • Identification data: full name, email address, phone number, profile photo.
  • Professional data (for doctors): professional license, specialty, official identification, professional certificates, office details.
  • Health data (for patients): clinical records, vital signs, diagnoses, medical notes, prescriptions, study and laboratory documents.
  • Location data: address and geographic coordinates of the office (for doctors who enable the location service).
  • Financial data: information on transactions and payments processed through the platform (card data is processed exclusively by Stripe and is not stored on our servers).

4.3. Purposes of data processing:

  • Management of medical appointments, including creation, confirmation, cancellation and follow-up.
  • Generation and storage of digital medical prescriptions.
  • Administration of electronic clinical records.
  • Verification of the identity and credentials of Health Professionals.
  • Payment processing and subscription management.
  • Sending service-related notifications.
  • Generation of reports and analytics for Health Professionals about their practice.
  • Audit logging of actions performed on the platform for security and regulatory compliance.

4.4. ARCO Rights: You have the right to Access, Rectify, Cancel or Object to the processing of your personal data at any time. To exercise these rights, you may submit a request through your account settings section or contact us directly at the email address provided in the contact section.

4.5. Health data is considered sensitive personal data under the LFPDPPP and receives enhanced protection. Its processing requires the express consent of the data subject, which is obtained upon acceptance of this privacy notice.

4.6. Data is stored on secure infrastructure provided by Supabase (cloud services), with encryption in transit (TLS/SSL) and at rest. Technical, administrative and physical security measures are implemented to protect data against unauthorized access, alteration, loss or destruction.

4.7. We do not share, sell or transfer personal data to third parties, except in the following cases: (a) when required by law, court order or competent authority; (b) for payment processing through Stripe, Inc.; (c) when necessary to protect the rights, property or safety of MedSuite or other users.

4.8. MedSuite maintains an audit log of actions performed on the platform (access to records, creation and modification of appointments, generation of prescriptions, configuration changes) for security, traceability and regulatory compliance purposes.

4.9. Personal data will be retained for as long as necessary to fulfill the purposes described in this notice, or in accordance with the periods established by applicable legislation. In the case of clinical data, the retention periods established by current health regulations will be observed.

5. Payments and Subscriptions

5.1. Subscription payments are processed securely through Stripe, Inc., a payment processor certified to PCI DSS standards. MedSuite does not store credit card, debit card or bank information on its servers.

5.2. Subscriptions renew automatically at the end of each billing period (monthly), unless the user cancels beforehand through the subscription management portal available in their account settings.

5.3. Cancellation of a subscription takes effect at the end of the current billing period. No partial refunds are issued for the remaining time of the paid period.

5.4. Subscription prices may be subject to changes, which will be communicated to users at least 30 calendar days before they take effect.

5.5. In the event of a failed subscription charge, MedSuite may retry the charge in accordance with Stripe's policies. If the charge cannot be processed after the corresponding retries, the subscription may be suspended or downgraded to the free plan.

5.6. For questions about payments, billing or disputes related to charges, the user may contact us through the channels indicated in the contact section or manage them directly through the Stripe portal.

6. Intellectual Property

6.1. All platform content, including but not limited to design, source code, texts, graphics, logos, user interfaces and visual elements, is the property of MedSuite and is protected by applicable intellectual property laws. Its unauthorized reproduction, distribution or use is prohibited.

6.2. Clinical data, medical records and content generated by Health Professionals and patients through the platform are the property of the corresponding professional and patient. MedSuite acts as custodian of such information in accordance with the terms of this agreement.

6.3. Trademarks, trade names and logos used on the platform are the property of their respective owners and may not be used without prior written authorization.

7. Limitation of Liability

7.1. MedSuite is provided "as is" and "as available". No express or implied warranties are given regarding the continuous availability, accuracy or fitness of the service for a particular purpose.

7.2. MedSuite shall not be liable for direct, indirect, incidental, special or consequential damages resulting from the use of or inability to use the platform.

7.3. MedSuite's maximum liability to the user, for any cause, shall be limited to the total amount paid by the user in subscription fees during the last 12 months.

8. Changes to the Terms

8.1. MedSuite reserves the right to modify, update or replace these terms and conditions at any time. Changes will take effect upon being published on this page.

8.2. Users will be notified of significant changes through the platform via internal notifications. Continued use of the platform after the publication of changes constitutes acceptance of the modified terms.

8.3. Users are advised to review this page periodically to stay informed about updates to these terms.

9. Governing Law and Jurisdiction

9.1. These terms and conditions are governed by the laws of the United Mexican States, including but not limited to: the Federal Law on the Protection of Personal Data Held by Private Parties, the General Health Law, and NOM-004-SSA3-2012 on the Clinical Record.

9.2. For the resolution of any dispute arising from the use of the platform, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction to which they may be entitled by reason of their present or future domicile.
